Article 1 – Definitions

Cooling-off period: the period within which the Consumer may exercise their right of withdrawal.
Consumer: a natural person not acting for purposes related to trade, business, or profession, who enters into a distance contract with the Entrepreneur.
Day: calendar day; March 1, 2025.
Continuing transaction: a distance contract concerning a series of products and/or services with delivery obligations spread over time.
Durable data carrier: any device that allows the Consumer or Entrepreneur to store personal information for future reference and unaltered reproduction.
Right of withdrawal: the Consumer’s right to cancel a distance contract within the cooling-off period.
Entrepreneur: Noro Viani BV.
Distance contract: a contract concluded using only remote communication methods within an organized online sales system.
Means of distance communication: any method that enables contract conclusion without physical presence.

Article 3 – Applicability

These Terms & Conditions apply to every offer from the Entrepreneur and to every distance contract and order concluded between the Entrepreneur and the Consumer.

Before a distance contract is concluded, these Terms & Conditions will be made available. If not reasonably possible, the Entrepreneur will indicate where they can be viewed and request a free copy.

If the contract is concluded electronically, the Terms & Conditions may be provided electronically in a way that enables easy storage on a durable medium.

Should specific product or service terms also apply, the Consumer may rely on the most favorable provisions in the event of conflicting conditions.

If any provision is invalid or void, the remaining terms remain effective and will be replaced with a valid equivalent reflecting the original intent.

Article 4 – The Offer

Offers are non-binding unless stated otherwise. Product descriptions are accurate and include essential details, but slight variations in color or finish may occur. Clear mistakes or typos do not bind the Entrepreneur.

  • Prices exclude customs duties and import VAT (borne by the Consumer).
  • Any shipping fees are disclosed.
  • Steps to complete a purchase are clearly outlined.
  • Payment, delivery, and performance methods are stated.
  • Any applicable right of withdrawal is specified.

Article 5 – The Agreement

The contract is concluded once the Consumer accepts the offer and fulfills the stated conditions. Electronic orders receive immediate confirmation. Until confirmed, the Consumer may cancel.

Secure payment and data transmission are ensured. The Entrepreneur may assess payment ability and decline orders when justified.

Essential order details and after-sales information will be provided with each purchase.

Article 6 – Right of Withdrawal

Consumers may cancel within 14 days of receiving the product. Items must be returned unused, in original packaging, and with labels intact. Notification of withdrawal must be made by email or in writing within 14 days of delivery, and the product must be returned within a further 14 days.

Article 7 – Costs of Withdrawal

Return shipping costs are the responsibility of the Consumer. Refunds will be processed within 14 days after receipt or proof of return shipment.

Article 8 – Exclusions

Returns may be excluded for personalized or custom-made products, perishable goods, hygiene-sensitive items once opened, digital products after download, or services commenced with the Consumer’s consent during the withdrawal period.

Article 9 – Pricing

Prices remain fixed during an offer period unless VAT or regulatory changes occur. Market-dependent prices may fluctuate, which will be clearly stated. Misprints do not bind the Entrepreneur.

Article 10 – Conformity & Warranty

Products comply with the contract and reasonable quality standards. Any manufacturer warranty supplements, but does not replace, statutory rights. Defects must be reported within 14 days of delivery. Warranty is void if products are misused, altered, or handled contrary to instructions.

Article 11 – Delivery & Execution

Orders are shipped with care to the address provided. Delivery occurs within 30 days unless otherwise agreed. Delays are communicated; the Consumer may cancel if delivery cannot be made in time. Risk of loss transfers upon delivery.

Article 12 – Continuing Transactions

Indefinite contracts can be canceled anytime with one month’s notice. Fixed-term contracts may be canceled at the end of the agreed term with a maximum of one month’s notice. Silent renewals are not permitted except under specific short-term subscription rules.

Article 13 – Payment

Payments are due within 7 business days after the cooling-off period starts, unless agreed otherwise. Incorrect payment details must be corrected immediately. Late payment may incur reasonable charges.

Article 14 – Complaints

Complaints must be submitted clearly within 7 days of discovering a defect. The Entrepreneur responds within 14 days, or provides an update if longer handling is needed. Valid complaints may result in free repair or replacement.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law, even if the Consumer resides abroad.

Article 16 – CESOP

In compliance with EU regulations (2024) under the Directive on Payment Service Providers and the implementation of the Central Electronic System of Payment Information (CESOP), payment service providers may be required to register certain transaction data within the European CESOP system.
